Terms of Service

1. Acceptance of Terms

By accessing and using Pettify ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the App.

Age Requirement: You must be at least 13 years of age to use the App. If you are under 13 years of age, you are not permitted to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that you have your parent's or guardian's permission to use the App and that your parent or guardian has reviewed and agreed to these Terms of Service on your behalf.

COPPA Compliance: The App is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child under 13 has provided us with personal information, please contact us immediately at [email protected].

2. Description of Service

Pettify is a pet care management application that provides tools for tracking your pet's health, activities, vaccinations, and daily care routines. The App includes features such as:

  • Pet profile creation and management
  • Health tracking and vaccination records
  • AI-powered care assistant (PetCareAI) powered by OpenAI
  • Activity logging and timeline
  • Family sharing and collaboration
  • Smart reminders and notifications
  • Data synchronization via Firebase
  • In-app purchases and subscriptions via Apple StoreKit

Payment Processing: All payments for subscriptions and in-app purchases are processed through Apple StoreKit. We do not collect, store, or process payment information. All payment-related terms and conditions are governed by Apple's terms of service.

3. User Accounts

To use certain features of the App, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. By using the App, you consent to the collection and use of information as outlined in the Privacy Policy.

Third-Party Services: The App uses third-party services to provide functionality:

  • Firebase (Google): For data storage, authentication, analytics, and push notifications. Your data is stored securely and handled according to Firebase's privacy policy.
  • OpenAI: For AI-powered features. Only pet-related data (not your personal information) is sent to OpenAI for processing. OpenAI does not store API request data (zero retention policy).
  • Apple StoreKit: For processing in-app purchases and subscriptions. All payment information is handled by Apple—we do not collect or store payment data.

Data Tracking: We do not use your data for tracking purposes. We do not track users across apps or websites owned by other companies. We do not use your data for advertising purposes.

5. User Content

You retain ownership of any content you submit, post, or display through the App, including pet profiles, photos, health records, and activity logs ("User Content"). By submitting User Content, you grant Pettify a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing and improving the App's services.

6. AI-Powered Features

The App includes AI-powered features such as PetCareAI, powered by OpenAI. These features provide suggestions and information based on the data you provide. Please note:

  • AI suggestions are for informational purposes only and do not constitute veterinary advice
  • Always consult with a licensed veterinarian for medical concerns
  • We are not liable for decisions made based on AI-generated content
  • Only pet-related data (names, breeds, health records, notes) is sent to OpenAI—your personal information (email, name, address) is never shared with third-party AI services
  • OpenAI does not store API request data (zero retention policy)
  • You acknowledge that AI responses may contain errors or inaccuracies and should not be relied upon as the sole source of information for important decisions

7. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the App or related systems
  • Use automated systems to access the App without permission
  • Interfere with or disrupt the App's functionality

8. Intellectual Property

The App, including its original content, features, and functionality, is owned by Pettify Labs and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Third-Party Services: The App relies on third-party services (Firebase, OpenAI, Apple StoreKit) that are provided "as is" without warranties. We are not responsible for the availability, performance, or security of these third-party services. Any issues with third-party services should be reported directly to the respective service providers.

AI Features: AI-powered features are provided for informational purposes only. We do not warrant the accuracy, completeness, or reliability of AI-generated content. AI responses may contain errors, inaccuracies, or outdated information.

10. Limitation of Liability

To the fullest extent permitted by law, Pettify Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.

Third-Party Services: We are not liable for any damages resulting from the use of or inability to use third-party services (Firebase, OpenAI, Apple StoreKit), including but not limited to service interruptions, data loss, security breaches, or API failures.

AI-Generated Content: We are not liable for any decisions, actions, or outcomes resulting from reliance on AI-generated content or recommendations. AI features are provided for informational purposes only and should not replace professional veterinary advice.

Data Loss: While we implement industry-standard security measures, we are not liable for any loss of data resulting from technical failures, security breaches, or other circumstances beyond our reasonable control. You are responsible for maintaining backups of your important data.

11. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Pettify Labs is established, without regard to its conflict of law provisions.
